ADEPT PHOTO BOOTHS TERMS AND CONDITIONS

 

1. Definitions

Adept Photo Booths: means Colin Richardson trading as Adept Photo Booths and any employees.

client: means the person, organisation, company or other body which is hiring the goods as specified on the Booking Form.

event: means the booking period and any set up or pack down time required in and around the booking period as outlined on the Booking Form.

event date: means the time and date of the event, confirmed by Adept Photo Booths and noted on the Booking Form.

booking form: means the online form completed by, or on behalf of, the client and Adept Photo Booths specifying details of the booking.

day: means a calendar day, unless specified otherwise.

2. Booking Confirmation 

2.1. A booking is not confirmed until the client returns a booking form, pays any costs as outlined under ‘Payments’ in these terms and conditions, and receives confirmation of the booking from Adept Photo Booths.

2.2. The booking details outlined in the booking form are deemed to be confirmed once the contract is signed. Changes after this time are not guaranteed and subject to availability.

2.3. Travel Fees may apply to events outside of the Perth and Melbourne metro areas at the complete discretion of Adept photo Booths. These fees may be added after a confirmed booking of the venue location is not disclosed at the time of booking as being outside of the Perth metropolitan or Melbourne metropolitan areas.

3. Payments

3.1. A non-refundable deposit of 50% of the retail price of the booking cost is payable upon booking. The booking is not confirmed until the deposit is received by Adept Photo Booths.

3.2. The balance of the booking cost is payable 14 days prior to the Client’s Event Date.

3.3. If the balance of the booking cost and the bond are not received more than 14 days before the event date, the booking will be cancelled, and the client will forfeit the deposit.

4. Event Delivery Requirements

4.1. The Client must ensure a safe and appropriate environment is provided for Adept Photo Booths to operate its equipment.

4.2. The Client must provide adequate time for Adept Photo Booths equipment to be set up, this is a minimum of one hour for all equipment except Green Screen and 360 photo Booths which require two hours.

4.3. The client must ensure: a space of 3m x 3m or more, access to 240v power within 10m of Adept Photo Booths’ equipment, all doorways and access paths are at least 80cm wide.

4.4. The Client must provide adequate and reliable Wi-Fi connection for access to digital photo delivery or sharing.

4.5. If the event is outdoors an undercover area must be provided as well as shelter from wind, moisture and direct sunlight.

4.6. A site visit of the event location may be required if Adept Photo Booths is not satisfied that a suitable location will be provided. This site visit may incur an additional fee to recoup costs. These costs may include, but are not limited to, parking, electricity and internet connection.

4.7. The Client is responsible for paying any charges imposed by the venue, or required to access the venue. These charges may include, but are not limited to, parking, electricity and internet connection.

5. Changes & Cancellations

5.1. Requests for changes of the event date must be made at least 30 days before the original event date. A date change is subject to availability and receipt of a new Booking Form.

5.2. If the client requests use of Adept Photo Booths’ services in excess of the time noted on the booking form, this will be billed at $100 for each additional hour or part-hour on a pro rata basis.

5.3. All cancellations will result in the client forfeiting the deposit, however if Adept Photo Booths is notified of cancellation more than 30 days before the event date, credit to the value of the deposit will be given to the client to use for any future booking made within six months of the date of cancellation.

5.4. Cancellations made within 30 days of the event date will result in the client forfeiting all payments made to Adept Photo Booths, with the exception of the bond which will be returned to the client within five business days after the date of cancellation.

5.5. Adept Photo Booths can cancel any booking at any time. If Adept Photo Booths decides to cancel a booking, all payments made will be refunded to the client.

5.6. If an event is cancelled as a direct result of state or federal government regulations relating directly to COVID-19, a full refund will be offered. To be eligible for a full refund, Adept Photo Booths require cancellation in writing more than 48 hours before start time of the event.

5.7. If the event is cancelled in writing, less than 48 hours from event start time, Adept Photo Booths will offer credit only for 100% of the booking fee and allow the client to use this credit for a new date within a twelve month period.

6. Damage To Equipment

6.1. In order to prevent damage to equipment, Adept Photo Booths reserves the right to deny service to any person.

6.2. If circumstances arise where a threat or implied threat of harm, damage or violence to Adept Photo Booths’ staff or equipment, Adept Photo Booths reserves the right to cease providing services. If the client is able to resolve the threatening situation within 20 minutes, Adept Photo Booths will resume services. If the situation is unable to be resolved, Adept Photo Booths will not resume providing service and the client will receive no refund of booking cost.

6.3. The Client is liable for any damage or theft to Adept Photo Booths’ equipment during the client’s event whether caused by the client, client’s guests or any other person in attendance at the event whether invited or not. Should such damage or theft occur, the cost to repair/replace the equipment will be charged to the client to be paid within 30 days of the event.

7. Use Of Images 

7.1. The client gives permission for all photographs taken during the event to be used on Adept Photo Booths’ website and other promotional material.

8. Indemnification

8.1. Adept Photo Booths will not be held responsible for any circumstances outside their control. This includes, but is not limited to, fire, riot, civil commotion, accidents, acts of nature and equipment failure. If such circumstances arise, all reasonable efforts will be made by Adept Photo Booths to provide service or find a suitable replacement service. If this is not possible, the client will receive a refund of all payments received by Adept Photo Booths for the booking.

8.2. The client agrees that in all circumstances, Adept Photo Booths’ liability is limited to an amount equal to the booking cost and not be liable for indirect or consequential damages.
